TERMS AND CONDITIONS
By booking with Fresh Fit Escapes Ltd (‘Fresh Fit’, ‘We’) you agree to be legally bound by the following terms and conditions (‘the Contract’). These should be read thoroughly prior to committing to a booking.
- Payment Policy
- To reserve a space on any Fresh Fit Escape (‘the Escape’), a non-refundable booking fee of £250 per person is required upon booking or full payment for the Escape. Payment of any outstanding sums owed (the balance) must be made within 60 days of the Escape start date if not already paid.
- You shall pay the cost of the Escape (’the Escape Cost’) at the rate set out on our website for the particular Escape booked, which is quoted inclusive of VAT at the prevailing rate where any is chargeable.
- Payment of the Escape Cost is payable via the website If you fail to make a payment under the Contract by the due date, then you shall pay interest on the overdue sum from the due date until payment of the overdue sum, whether before or after judgment. Interest under this clause will accrue each day at 8% a year above the Bank of England’s base rate from time to time, but at 8% a year for any period when that base rate is below 0%.The cost of the Escape (‘the Escape Cost’) DOES NOT include flights or travel insurance. It is your responsibility to make these arrangements.
- Cooling off period
- There is no cooling-off period applicable when purchasing or booking any of our Escapes.
- Cancellations
- It is your responsibility to read and understand our cancellation policies at clauses 4 and 5 below before making a reservation. We know no one books with the intention of cancelling or postponing their trip, but unexpected things do happen, so please consider purchasing travel cancellation insurance as soon as you have booked your trip.
- Cancellations Policy: Guest Cancellations
- If you cancel 60 days or more before your Start Date, you will be refunded the full amount of the Escape Cost paid up to that date for your retreat, less the £250 per person booking fee which is non-refundable.
- Cancellations less than 60 days before the Start Date of your Escape are non-refundable and will result in a forfeit of the total Escape Cost. Any amount of the Escape Cost unpaid at the date of cancellation will become payable immediately.
- Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason.
- We do not offer a discount on the total Escape Cost for arriving late to our Escape or departing early.
- Please note that if you choose to cancel your Escape for reasons related to Covid-19 (or any other future pandemic situation) in circumstances where the Company has not been required to cancel the Escape (either by direction of the UK government or due to the destination country closing its borders to UK guests) then you will remain liable to pay the entirety of the Escape Cost.
- Cancellations Policy: Cancellations made by the Company
- If for any reason Fresh Fit Escapes must cancel or change the Start Date of any of our Escapes, for any reason whatsoever, you’re entitled to transfer the sums paid to another Escape (either already scheduled or intended to be at some future time) to be used as credit. Alternatively, you may request a refund of payments made by you to the Company, which will be accommodated for insofar as is possible.
- Fresh Fit Escapes is not responsible for your expenses incurred in preparation for any cancelled Escape such as other accommodation, airline tickets, loss of work, insurance and/or other costs associated with preparing for your trip.
- Travel Insurance
- It is your responsibility to organise suitable travel and health insurance. You acknowledge that Fresh Fit Escapes is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially or otherwise.
- You understand and acknowledge that it is a condition of booking that you must take out an adequate travel insurance policy that covers all items listed in the sample itinerary for your chosen Escape, as well as but not limited to, trip cancellation insurance, and any other activities that which may reasonably be undertaken during the course of your Escape. The policy and insurance coverage must be valid and in effect for the entire duration of your Escape.
- Please note, even if you have private health insurance in your Country of Residence, it is unlikely that this insurance will cover overseas trips to the extent required to participate in the activities organised on a trip with Fresh Fit Escapes.
- Passports, Visas and Documents
- It is the responsibility of each participant to obtain a valid passport, visa(s) and necessary certificates for any country to be visited in connection with any Fresh Fit Escape.
- Third Parties
- Fresh Fit Escapes holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on an Escape as compared with the advertised nature of the service.
- Further, Fresh Fit Escapes accepts no responsibility for delayed, missed or cancelled flights, buses, ferries, transfers, or any other modes of transportation required by you to get to your accommodation, or any other activity or event in connection with or relating to your retreat.
- Minimum age
- The minimum age for attending any retreat with us is 18. By booking an Escape you are providing a warranty that you are a minimum of 18 years old.
- Your Health & Risks
- You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do any form of active exercise.
- You warrant that you are aware that all exercise and travel carries risks, and acknowledge you are participating willingly, and in knowledge of these risks.
- You recognise that We are not medical professionals, and that any information provided should be used as a guideline only. If you have any prior knowledge of health concerns or health risks, you acknowledge that it is your responsibility to seek clearance from a health care professional prior to attending any of our retreats.
- You agree to fully indemnify without limitation any trainer(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for Fresh Fit Escapes.
- General Waiver
- You agree to sign a waiver with Fresh Fit Escapes at least 30 days before your retreat Start Date.
- You acknowledge that during any trip with Fresh Fit Escapes you participate voluntarily in any and all activities arranged, and insofar as is legally permissible, you surrender your right to any cause of action against Fresh Fit Escapes, their agents, contractor’s, employee’s and directors, arising from any loss or damage to any person or property that occurs during a Fresh Fit Escape up to and including death.
- Limit on our responsibility to you
- Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:
- losses that:
- were not foreseeable to you and us when the contract was formed;
- that were not caused by any breach on our part;
- business losses; and
- losses to non-consumers.
- losses that:
- Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:
- Your privacy and personal information.

- Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complain about the use of your personal information.
- Photo / Video Release – Use of Image
- You hereby grant to Fresh Fit Escapes the absolute and irrevocable right, and unrestricted permissions to use photographic portraits/images/videos in which you feature that are taken during the retreat to use/republish/copyright, etc. for commercial use in association with Fresh Fit Escapes. You hereby release and discharge Fresh Fit Escapes from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.
- Third party rights
- No one other than a party to this contract has any right to enforce any term of this contract.
- Disputes
- We will try to resolve any disputes with you quickly and efficiently.
- If you are unhappy with:
- the services we provide;
- our service to you generally; or
- any other matter,
please contact us as soon as possible.
- If you want to take court proceedings, the courts of England and Wales will have exclusive jurisdiction in relation to this contract.
- The laws of England and Wales will apply to this contract.
By booking any retreat with us you agree to be bound by and adhere to all policies and rules that we may notify you of from time to time.
